I bought a tranny on here last year (9 months ago)...The guy said he would have the tranny at my house within a week or recieving the payment! Well guess what, Still no tranny! I have contacted the police couple times and they said that there is nothing they can do?? Im sure some of you have been through the same situation as me!
How did yall fix or resolve the problem? You take them to court? or what? I need help on what to do?
Im only 19 yrs old so going through this process is kinda new to me! I bought the tranny while i was deployed to Afghanistan last year and I also have the receipt from paying for it, and documents showing he received my check and cashed it!
How would i go among this situation? the right steps on going to court...etc

I kind of figured that one. that little bastard has ripped a lot of people off. As far as jurisdiction goes, that's a tough one. Ordinarily it got to the location of where you lived when the transaction took place. Since it was Afghanistan that's not gonna work. I don't know how close to you live to the thief in question, but I would file a small claims action on him with the court jurisdiction that he lives in. At least you have a chance at getting him in court. He's actually ripped enough people off that I would consider filling theft by deception charges on him if it were me. But it's not my jurisdiction and that would be up to the local LEO. Good Luck PS when your in town filling suit on him. I'd stop by his house and pay him a visit.

They are going to swing by his house today and see what his deal is, They said they are going to try and get him on charges but if not then i would have to go up there myself and file civil suit!

A check sent in the mail is the best transaction to be ripped off on. This person that is ripping you off now has committed mail fraud. This is a felony. You can file online with the USPS, and it will be investigated by postal authorities. Penalty for defrauding an individual would be up to five years and $250,000 fine. The webpage to start from is here: ehome.uspis.gov/fcsexternal/default.aspx

At the end of the lease he went a-wall, didnt get a dime, phone call, returned text, or an invoice for 'damages' back but apparently he felt he needed the money. I will have to talk to a lawyer. In my opinion i would love to tag someone thing on that POS. Edit: i actually did get a text back..... He said i never signed the lease when i mailed it it to him with the check. But still took 12 months of rent.

It's a F'ed up deal, his friend trashed the house when they lived there before us, all 4 of us got shafted $320. he can keep the $320, i think he's a slumlord and i want to nail him with something that is going to cost him alot more than $320. I have the text where he said the lease 'wasnt' signed. and he took my check after i mailed it.
Honest, I even thought about calling judge judy.

I will put it truthfully. Your f--ked. Small claims does nothing but gets you a decisison. Small claims cant make them pay. All they have to do if they loose in small claims court is cry to the judge that they are broke. The court will allow them to make a super small monthly payment to you. you will never get your money back. The laws are set up for the scumbags benefit. If you win small claims, in most states you have to pay for the court costs. I had a business where I got ripped off several times a year, just had to eat it. my mom is a landlord, she tried the court system only to find out its a joke too. She just took the loss. Sorry for the truth but for 1300, you still spend that much trying to get it back.

Because, if he ever hits the "Rodney King" lottery you'll be first in line to get paid. And judging by the way he conducts business, I can see that happening. Plus I'd pursue criminal charges against him as well, the satisfaction of him sitting in jail would do it for me. Plus you can get restitution ordered through the court

Small claims is a real pain, but it can eventually work out if you jump through all the hoops.
Short story / long story Bought a car when I was in college, guy had fixed it up and sold it to me with a clear title. Few months later I get a letter from the DMV saying it had a salvage title in another state and was given a salvage title for my state. Tried to deal with the seller a few times, but there was always some excuse. (he did buy the car out of state, fix it and sell it).
Went to small claims court they told me to give him the car back and the guy should give me the money. I give the car back and... no money. Guy stops showing up for court dates, eventually they impound a few more of his cars, but by the time they sit at the tow yard for 60 days collecting storage I ended up with a few hundred bucks. Court enters a judgement against in... I lick my wounds, and forget about it.
8 years later guy gets picked up for a dui and posts bail. I get a letter to appear in court.. and they give me his bail money.
Eventually it worked out, but took almost a decade and only because he got popped for a DUI.
